Two actions in the Ramsey County District Court arising out of a collision involving a truck maintained by Northwestern Refining Company, Inc., and driven by Vernon Scheid; an automobile owned and operated by Richard S. Lambach; and an automobile driven by Gerald E. Fitzgerald. One action was brought by Gloria A. Lambach as trustee for the heirs of Richard Lambach, who died as a result of the accident, against Northwestern Refining Company and Scheid. The other action was brought by Fitzgerald for his personal injuries and property damage against Gloria A. Lambach, administratrix of the estate of Richard Lambach; Scheid; and Northwestern Refining Company. The cases were tried together before James C. Otis, Judge, and a jury, which found that defendant Scheid was guilty of negligence which was a proximate cause of the accident; that Lambach was not guilty of negligence which was a proximate cause of the accident; that plaintiffs were entitled to damages of $25,000 and $30,000 respectively. Defendants Scheid and Northwestern Refining Company appealed from an order in each case denying their alternative motion for judgment notwithstanding the verdict or for a new trial.
